In the event that a booking is cancelled, the following fees will apply:

	<li>Cancellations 7 days or more before departure: no fee</li>
	<li>Cancellations between 6 and 3 days of departure: 50% of the total cost</li>

	<li>Please note: All kayak tours are subject to favourable weather and sea conditions. If a tour is 
	cancelled due to poor weather or sea conditions, you will be given the option of an alternative tour date or full refund.</li>

Clothing suitable for kayaking is required, including shorts, t-shirt, warm top, leggings 
(particularly in winter). Please do not wear denim, long pants (not even rolled 
up) or &frac34; pants

ABOUT FERGS KAYAKS

&nbsp;

Fergs Kayaks all started from the success of&nbsp; kiwi born, kayaking legend, Ian Ferguson and his gold medal win at&nbsp;1984 Olympic Games in Los Angeles. Ian wanted to encourage the sport of kayaking and create a safe, fun experience for the first time kayaker. In 1990 Fergs Kayaks was born&nbsp;and pioneered the&nbsp;night kayaking trip to Rangitoto which continues to this day. They now have two waterfront locations, in Auckland and Wellington.

ON THE DAY

&nbsp;

&nbsp;DEPART 8:30AM

Your North Head Military Bunker Kayaking Trip will depart from Fergs Kayak Base at Okahu Bay (10mins from downtown Auckland) at 8:30am. Your experienced guide will give you a short safety briefing before you depart. From there you will paddle across the picturesque Auckland Harbour (Waitemat? Harbour) towards the pretty seaside village&nbsp;of Devonport. You&#39;ll then paddle around North Head&nbsp;(Maungauika) to Cheltenham Beach, where you can take a dip and swim around the beautiful bay.

&nbsp;

After your swim, you&#39;ll head up the walking track&nbsp;from Cheltenham Beach to the summit of North Head. Take a moment to soak up spectacular views of Auckland Harbour and the city. While you&#39;re&nbsp;there your guide will give you an informative tour about the historic features of North Head including military tunnels and historic gun emplacements. North Head is an extinct volcano and has been used as&nbsp;a defensive vantage point over the years, throughout both&nbsp;World Wars, this iconic Auckland landmark is not to be missed!

&nbsp;

You&#39;ll paddle back to Fergs Kayak Base at approximately 11:30am.

1. I recognise that there are certain inherent and unavoidable risks associated with sea kayaking and that there is the possibility of personal injury to myself or others and there is also the possibility of loss or damage to property belonging to myself or others.&nbsp;

&nbsp;

2. I agree to observe and follow any instructions given to me by the supplier representatives, including important details on the website and any emails or other communications from the supplier about what to expect, what to bring, what to wear and where I need to be at what time, and to make sure any children in my care do the same.

&nbsp;

3. I confirm that I am physically and mentally capable of carrying out the activities and that I do not suffer from any medical conditions which may be aggravated by undertaking the activities and that I have not been advised otherwise by a qualified medical person. I am not taking any medication that may adversely affect my ability to safely carry out the activities.

&nbsp;

4. I consent to receive medical treatment in the case of injury or illness during the activity and agree to indemnify the supplier against any claims in respect of that treatment.

&nbsp;

5. I agree that I must be clear of influence from drugs and/or alcohol to utilise equipment or undertake activities with us.

&nbsp;

6. I accept that I may be removed from the premises/the kayak if any of the supplier representatives (including any guide engaged by the supplier) believe that I may be a danger to myself or others in the circumstances or may otherwise cause damage or loss to any property.&nbsp;

&nbsp;

7. To the greatest extent permitted by law, on behalf of myself, my executors, administrators, heirs, next of kin, successors and assigns, and anyone else who might sue on my behalf, I waive, release and discharge the supplier, and its representatives, agents and invitees (including but not limited to any guides engaged by the supplier) from any and all liability for death, disability, personal injury, loss, additional expenses, property damage, theft and all other foreseeable risks, claims or actions of any kind (including negligence) whatever and however occurring which may arise, at any time, from or in connection with, directly or indirectly, as a consequence of my participating in the activities.

&nbsp;

8. I accept liability for any damage or injury to third parties and their property incurred or caused by myself whilst using hire equipment from the supplier or while I am undertaking any activity with any guide engaged by the supplier.

&nbsp;

9. I accept that the supplier reserves the right to cancel or change the details of any tour in which case I have the option to receive a full refund or book an alternative tour provided I pay the difference in price (if any).

&nbsp;

10. I accept that if I miss the tour departure time (for any reason whatsoever) or I am excluded from the tour by the supplier , including any guide engaged by the suppliers, as a result of, in their opinion, my breach of the terms and conditions of this Customer Acknowledgement (including my lack of physical or mental capability to undertake the activity, ill health, intoxication or my being under the influence of drugs), there shall be no refund.

&nbsp;

11. I accept that if I cancel my booking, I am entitled only to the following:

&nbsp;

(a) If I cancel at least 7 day(s) in advance of the scheduled departure, there is no cancellation fee.

&nbsp;

(b) If I cancel between 3 and 6 day(s) in advance of the scheduled departure, there is a 50 percent cancellation fee.

&nbsp;

(c) If I cancel within 2 day(s) of the scheduled departure, there is a 100 percent cancellation fee.

&nbsp;

12. Payment in full for all tours must be received at the time of booking. No booking is confirmed until an email is sent by the supplier confirming that the booking has been accepted. I agree to make payment via a debit to my nominated credit card. The amount debited will be an amount shown in New Zealand dollars (inclusive of New Zealand Goods and Services Tax) on the booking page prior to me clicking &ldquo;Submit Payment&rdquo; on that page and I will be charged to my credit card in the amount shown or converted to my local currency of the credit card company. The supplier is not responsible for any currency conversion or any foreign exchange fee and other fees that my credit card provider may impose. The supplier website payment page is fully hosted by DPS and credit card details will not be collected and stored by the supplier website.

13. These terms and conditions may be amended by the supplier from time to time and any amendments will be effective immediately upon their being posted on the website and my continued use of the website shall be deemed to be acceptance of these terms and conditions. I also accept that it is my responsibility to ensure that my access to this website is not illegal or prohibited by the laws which apply to me.

14. I accept that it is my responsibility to take my own precautions to ensure that the process which I employ for accessing this website does not expose me to the risk of viruses, malicious computer code or other forms of interference which may damage my own computer system. The supplier has no responsibility for any damage or interference caused to my own computer systems which arise in connection with my use of this website or any linked website.

I agree that any films, sound, video or other records taken of or during the activity will not be used in any promotion or advertising without the prior approval of the supplier but that the supplier may use such recordings itself at its complete discretion without any prior approval from me.

18. I agree that this acknowledgement is covered exclusively by the laws of New Zealand and agree to submit to the exclusive jurisdiction of the Courts of New Zealand.
